Personal Injury: When can I make a claim


There is a three year time limit for issuing court proceedings beginning on the date of the accident or the date on which an individual knew that they had been injured as a result of an act or omission by a third party (for example, in an asbestos disease claim the date of diagnosis).  In claims involving children the three year period does not begin until their 18th birthday. The courts do have discretion in certain circumstances to allow claims out of time – but this should not be relied on because it is uncertain and can cause difficulties with funding.


Investigating a claim takes time and it is better to contact a lawyer sooner rather than leave it close to the time limit.
