Since 2005 gay and lesbian couples have been able to enter into Civil Partnership, often referred to as a marriage. The law applying to couples who separate and divorce is similar to heterosexual divorce law although there are some differences. For instance adultery is not a ground which can be used for divorce, although infidelity will almost certainly be sufficient to proceed on the basis of unreasonable behaviour.

 

The parties are entitled to make financial claims and the Courts have the same powers as in a heterosexual divorce. Technically the process of ending a same sex marriage is "dissolution of a civil partnership" although it is often referred to as a divorce.

When gay and lesbian couples live together without entering into a civil partnership, the legal principles which apply are the same for any unmarried couple whether they are the same sex or not.
