We work with clients to identify the most appropriate procurement route (traditional, design and build, management contracting) for their project and the likely risks and how they might be addressed through the checks on competence and financial stability, through the terms of the contract, warranties, bonds, performance guarantees and insurance.
Dispute resolution
Construction disputes are often complex and expensive, an unwelcome drain on clients’ time and money. Disputes put a project at risk, prejudice working relationships and may affect other and future contracts, reputations and insurance premiums.
Our knowledge of industry contracts and practice enable us to respond quickly, potentially reducing the impact of the issue and the risk of hardening, entrenched attitudes. We work closely with clients quickly to establish the facts and technical issues and give initial advice on protection of their position in respect of all relevant contracts and insurances including professional indemnity insurance.
Focusing on narrowing the issues, giving pragmatic and realistic advice and fully involving clients, reflecting their needs and objectives in strategy and decision making, we use appropriate processes (including adjudication, arbitration and litigation) and alternative dispute resolution methods (mediation, negotiation, early neutral evaluation, conciliation and expert determination) to resolve disputes, aiming for an early and cost effective solution, but prepared to go to formal decision award or judgement to obtain the best outcome for our clients.
We will act for all players within the construction industry and have a number of fee options for construction work ranging from fixed fees to “no win no fee/discounted fee” for suitable cases.
