Clinical Negligence: Who can make a claim

If the injury has happened to a child then usually one of the parents would act as the litigation friend for the child until the child reaches the age of 18.  In the event of a death the claim is made in the name of the personal representatives on behalf of the estate of the person who has died and those who are financially dependent on the deceased. Otherwise the injured person usually makes the claim.
